KINGFISHERS AT CRETINGHAM (“Kingfishers”)

WAIVER OF LIABILITY, ASSUMPTION OF RISKS, RELEASE & INDEMNITY AGREEMENT

 

NOTE TO PARTICIPANT

 

1. Participation in any water sport exposes the participant to certain risks and dangers, accidents, and injuries (superficial to fatal). To ensure safety, the participant acknowledges the presence of trees, branches, weeds, rocks, sand, roots, plant life, bacteria, marine life, wildlife/insects, obstacles natural and manmade, other persons and their equipment and are all risks and hazards.

 

2. I, the participant, understand that there are foreseeable, unforeseeable and inherent risks of injury involved in the activity of water sports and using the hire equipment including, but not limited to, falls, collisions, cuts, bruises, sprains or strains resulting in damage to bones, joints, ligaments, muscle or other body parts and the risk of drowning.

 

3. In some cases, participants may suffer other risks which could include abnormal blood pressure, fainting, changes to heart rhythm, strokes and in certain instances heart attack, brain damage, drowning, other causes of distress or even death.

 

4. I hereby affirm that I the participant is in good physical, mental and willing condition to take part in the hire activity. If you are in any doubt, please consult your GP first.

 

5. I agree that I, the participant, will report and stop the water activity in the event of equipment failure or improper use which may cause discomfort or distress to oneself or others. I agree that everyone is entitled to enjoy the water hire safely and its natural surroundings.

 

6. The use by me of any equipment provided by Kingfishers constitutes my acceptance of the equipment on a temporary basis. I will pay Kingfishers for any loss, damage or destruction of the equipment.

 

7. I acknowledge that the consumption of any alcohol and/or mind altering substances/drugs (which may or may not include illegal or prohibited substances) before taking part in the water sport on the boating lake, is dangerous and is likely to increase the risk of personal injury and damage to property and that no consumption

 

 

 

8. of alcohol or drugs is permitted before or during the event and that if found to be under the influence will result in me not being able to or no longer being able to participate in the boating activity.

 

 

9. I acknowledge there is a risk that my personal property including clothing, jewellery and other equipment can get lost, damaged and destroyed. That Kingfishers will also not accept responsibility for any personal belongings left unattended anywhere on these premises.

 

10. I AGREE THAT I WILL WEAR THE APPROVED PROTECTIVE/ SAFETY GEAR AT ALL TIMES TO PARTICIPATE IN THE WATER HIRE ACTIVITY. I FURTHER AGREE THAT NO PROTECTIVE/ SAFETY GEAR CAN TOTALLY PREVENT INJURY OF ANY KIND.

 

I HAVE READ THIS WAIVER OF LIABILITY, ASSUMPTION OF RISKS, RELEASE & INDEMNITY AGREEMENT AND I FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND AM AWARE OF THE LEGAL CONSEQUENCES. THAT BY SIGNING IT I HAVE SIGNED IT FREELY AND VOLUNTARILY AND WITHOUT ANY INDUCEMENT.

 

FOR PARTICIPANTS OF UNDER 18 YEARS OF AGE: By signing the booking form you certify that you, as Parent, Legal Guardian, Temporary Guardian with legal responsibility for this participant, do consent and agree not only to his/ her release of all releases, but also to release and indemnify the release of all liabilities incidents to his/her involvement in these activities, my heirs and assigns and next of kin. As Parent, Legal Guardian, Temporary Guardian with legal responsibility for this participant remain responsible for the welfare and safety of this child/ children at all times.

 

If the participant is a minor and by their signature, they on my behalf, release all claims that they and I have.

 

IF YOU SUFFER FROM ANY MEDICAL CONDITIONS OR ARE TAKING ANY FORM OF MEDICATION WHICH COULD AFFECT YOURSELF OR OTHERS ON THE WATER PLEASE SUPPLY OUR HIRE STAFF WITH THIS INFORMATION SO THAT WE CAN DECIDE WHETHER IT IS SAFE FOR YOU TO PARTICIPATE IN SAID ACTIVITIES.

 

BY THE ELECTRONIC SIGNING OF THIS HIRE WAIVER YOU CERTIFY THAT THE ABOVE INFORMATION IS CORRECT TO THE BEST OF MY KNOWLEDGE

ADDENDUM:

 

FOR YOUR SAFETY AND COMFORT:

 

i)                 Wear a buoyancy aid at all times.

ii)               Please dress appropriately for adverse weather conditions.

iii)              Wear appropriate shoes. Open toe shoes not allowed.

iv)              Cover all cuts and open wounds with a waterproof dressing.

 

 

 

 

v)               Parent, Legal Guardian, Temporary Guardian with legal responsibility for this participant remain responsible for the welfare of the child/ children at all times.

vi)              Tie long hair back

vii)            Remove jewellery

viii)           Please dress appropriately for all weather conditions. Suitable clothing must be worn.

ix)              Bring all medication you may need throughout the activity.

x)               Wear sensible shoes.

xi)              Wear clothes you don’t mind getting dirty or even slightly damaged.

xii)            Do not bring mobile phones or other valuable items into the boat/kayak. Kingfishers will not be held responsible for any loss or damage to any personal items. Any items taken on to the boat or kayaks are entirely at the owner’s own risk.

xiii)           Bring a towel.

xiv)           Cover all cuts and open wounds with waterproof dressing.

Ticketing Terms & Conditions

  1. Bookings are for Kingfishers at Cretingham Country Park, Swan Lane, Cretingham, Woodbridge, Suffolk IP13 7BA.
  2. Bookings are for 1 day, valid for the date and time selected at time of purchase only. Access may be denied if you visit without a booking or for an invalid date.
  3. Bookings are subject to availability.
  4. We reserve the right to request proof of age to ensure that the correct ticket has been purchased.
  5. Payments for bookings are non-refundable.
  6. Tickets are transferable up to 48 hours in advance only. Please send us an email at info@kingfisherscretinhgam.co.uk or call 01728 685275 to do so, or if you booked online you may do this yourself by logging in to your account.
  7. To gain entry you must show booking. Please show the barcode ticket on your phone or print out.
  8. Discount codes (where applicable) for bookings can be discontinued at any time.
  9. Children under 16 must be supervised by an adult at all times inside the park.
  10. Our tickets are not available for resale and we do not accept tickets bought via any third party unless arranged and approved by management.

Terms of Entry

Entry to Kingfishers adventure playground and boating lake, including free and paid-entry areas are subject to the Terms and Conditions of Entry below.

  1. Full clothing must be worn at all times.
  2. All rules of play as displayed within the adventure play and boating areas must be adhered to. Failure to do so will result in being told to leave immediately without any refund being given.
  3. Smoking is not permitted on site unless in designated smoking areas.
  4. Dogs are not allowed in the adventure play or boating lake. You are not allowed to leave your pet in the car unless accompanied by a responsible adult. This applies at any time of year and weather conditions. Anyone found with a pet in their car will be asked to leave immediately. No refunds will be given.
  5. Cars parked in Kingfishers at Cretingham Country Park’s car park are parked at the owners own risk and Kingfishers at Cretingham Country Park cannot be held responsible for loss or damage to vehicles, their contents or persons.
  6. Children aged 16 and under must be supervised by an adult at all times whilst at Kingfishers at Cretingham Country Park.
  7. Bicycles, scooters, children’s cars, skate boards, rollerblades, or roller skates used at Kingfishers at Cretingham Country Park is entirely at your own risk  Kingfishers at Cretingham Country Park cannot be held responsible for any loss or damage or persons.
  8. Kingfishers at Cretingham Country Park cannot be held responsible for loss or damage to visitor’s possessions at Kingfishers at Cretingham Country Park, in the car park including but not limited to any of the cafés, bar or restaurant.
  9. Photography for commercial use is not permitted without the expressed permission of Kingfishers at Cretingham Country Park.
  10. Kingfishers at Cretingham Country Park will not tolerate physical or verbal threats towards its staff and operate a complete zero-tolerance policy. Any visitors behaving inappropriately will be denied access to, or told to leave immediately, without refund being made.
  11. Kingfishers at Cretingham Country Park reserves the right to close any or all parts of the park as necessary or temporarily close without notice due to damage to facilities, inclement weather, power failure or for any other reasons. Refunds cannot be offered under these circumstances.
  12. Non-adherence of terms and conditions of entry will result in being told to leave immediately without any refund being given.
  13. The boats on the boating lake are run by The Boat Shack Limited at Kingfishers.  This is a separate company.

GENERAL TERMS

All bookings are subject to these terms, which supersede any previous terms.

11.Kingfishers at Cretingham Country Park reserves the right to amend terms at any time without notice, although the current terms are available at www.kingfisherscretingham.co.uk and any amendments to terms governing confirmed bookings will be notified by email.

12.In the event of supply difficulties Kingfishers at Cretingham Country Park reserves the right to substitute goods or services of equal quality and value.

13.Kingfishers at Cretingham Country Park will not accept any responsibility for any loss, damage, delay or other disruption in supply and deliveries brought about by delayed or incomplete payment.

14.In the unlikely event of a power cut, we will take reasonable steps to ensure power is restored with minimal disruption. Kingfishers at Cretingham Country Park will not issue and refunds and reserves the right to close due to health and safety.

15.We may take and use photographs or video footage of events at Kingfishers at Cretingham Country Park, to be used for social media and marketing purposes, if you do not wish your image to be used, please let us know.

16.There is ample parking at the venue, but Kingfishers at Cretingham Country Park accept no responsibility for damages or losses incurred from using our facilities.

17.Guest’s vehicles can be left overnight at owner’s risk but must be collected by 10:00am the following morning.

Further information

1.    Nothing in these Terms and Conditions will reduce your statutory rights. Kingfishers at Cretingham Country Park is the trading name of Kingfishers Cretingham  Ltd. For further information about your statutory rights visit www.suffolk.gov.uk/tradingstandards

2.    Event tickets may be refunded on the terms of the third party event organiser, demonstrator or promoter.
